To force the earthly courts to apply the divine norm is an act completely incompatible with the modernity, it is exactly what the Inquisition used to do. Romanian Orthodox Church (BOR), by its direct action or by the agency of the demagogic use of its real or supposed influence in society by the politicians, is an important obstacle in Romania's modernization obstacle. By BOR we understand the majority of the ones that presently lead the Church, and not its servants on a whole or, like its defenders would probably hurry to say, the orthodox faith. The way directly used by BOR is public opposition to the adoption of legal rulings specific to an open and pluralist society. First of all, we should refer to the Church's freedom. In a pluralist society, except for the extreme cases, as racism or incitement to dictatorship, to ask that another individual's right be violated is a permitted by the rules of the game, a clear distinction being made between expression and fact. The abuse agianst immigrants is punished, for instance, but no the free expression of harsh and unjust ideas against them. In accordance to the same model, BOR can ask however vehemently it wants, for instance, that homosexuality remain illegal, It is basically their right to do it. Though, the principle, as it functions in Romania, is vitiated. Out of two reasons. First of all, homosexuality is illegal, while to express opinions against it is perfectly legal. The BOR officials cannot pretend they do not notice this difference: they do not express a point of view, they actually want to apply it, knowing they have enough influence to succeed; therefore, they want to violate a fundamental human right, on the basis of a juridical fiction of its absence from the Romanian law.
