The Insurance Supervision Commission (CSA) slapped a fine on five insurance company managers worth one net salary, because some of the brokers or agents that work with those companies were selling auto liability insurance policies (RCA) on the streets. The managers fined by the CSA are Boris Schneider from Asirom, Dumitru Ceraceanu from Asiban, Bogdan Stan from Asitrans, Radu Mustatea from Astra-Uniqa and Constantin Toma from Omniasig.
Asirom, Asiban, Asitrans and Astra-Uniqa bosses challenged this decision, saying they had notified their brokers and agents about the new stipulations of the CSA, while Omniasig officials did not return any comment.
In mid July, CSA chairperson Angela Toncescu prohibited the sale of mandatory auto liability insurance policies on the streets, at street stands or in cars in order to reduce the errors in the Cedam database, which includes information about every RCA policy issued by insurers. The CSA has been conducting inspections ever since to identify the companies whose brokers or agents sell RCA policies in places that are not specifically designed for this purpose. These inspections resulted in a series of written warnings sent by the CSA to companies, with the last of these penalties coming in the form of one net salary for the bosses of the insurance companies, a month ago.
According to the legislation in force, the Commission may penalise managers of the insurance companies with one to six net salaries (calculated in line with the net salary in the month before the infringement was found).
Dumitru Ceraceanu, Asiban general manager says he should not normally be penalised because his company notified the brokers and agents it works with that it is prohibited to sell RCA policies on the streets. He did not pay the fine and challenged CSA's decision.
