* The European Parliament will debate tomorrow the bill for prohibiting mining using cyanides across the European Union
In a press release sent yesterday to our editors, Greenpeace Romania and the Legal Resources Center urge the Ministry of the Environment and Forests to reject the application for the environmental permit submitted by the company involved in the Roșia Montană gold mining project, which would allow the latter to begin the exploitation of the gold deposit in Roșia Montană. The two non-governmental organizations claim that the request represents a preliminary statement of complaint, according to the Law no. 554/2004 concerning administrative litigation procedure, with its subsequent additions and revisions.
The Minister of the Environment and Forests has 30 days available to reject the non-compliant documentation. Failure or refusal to reply will result in legal action being taken against the Ministry, the two NGOs said.
"The documentation submitted with the Ministry of the Environment and Forest is outdated. According to the ruling 157/2007 issued by the Court of Appeal of Braşov, the Cârnic mountain may no longer be exploited, so it should be excluded from the project", said Cătălina Rădulescu, the lawyer representing the Legal Resources Center.
Greenpeace Romania and the Legal Resources Center claim that given this definitive ruling, the documentation submitted with the Ministry of Forests and the Environment is basically incomplete.
The members of the European Parliament will vote tomorrow on a bill intended to prohibit mining using cyanide-based technologies in the entire European Union. The bill was initiated by Laszlo Tokes and Janos Ader.
